CANCELLATION POLICY.
All cancellations must be received in writing (by US Mail or email) prior to the
first day of the month. Telephone request will not constitute acceptance of
any cancellation. Termination request must include the following:
- Company/Client Billing Name
- Exact service/s terminating
- Termination effective date
Eclicks, Inc. is not responsible for any data that is lost due to
termination of services by the Client or by termination of services initiated
by Eclicks, Inc. for any reason. Client may request a copy of their
website files and data at a rate of $50 per hour, with a minimum charge of
$25.00. This request must proceed or accompany Client's termination
notice. This service is not availible for Clients with past due amounts.

BILLING.
Payment is due prior to usage for all services. Your bill is prorated to
the end of your first month, and billing occurs monthly after that.
Billing is not determined by weather Client has uploaded files to webspace,
nor if there is a malfunction due to Client error. Where Net 30 terms have
been granted, any account that is more than thirty (30) days late in payment
of invoices is subject to disconnection and a $50 reinstatement fee when the
past due and current balances have been paid with certified funds. In the event
that legal action is necessary for the collection of fees, Client agrees to
pay all attorney costs necessary for collection of said fees. Jusrisdiction of
all disputes is Forsyth County, NC. or Horry County, SC, at the discretion of
Eclicks, Inc.
WEBSITE DEVELOPMENT.
All of our websites include custom coding and graphics. Eclicks, Inc.
gives all Clients a perpetual non-exclusive license to use code and graphics
developed for the Client with the code and graphics residing on our
corporate servers. All code and programs are the exclusive intellectual
property of Eclicks, Inc. and are not the property of the Client under
any circumstances. All code and programs developed for Clients resides on our
corporate servers and is available for Client's use only from those servers.
REFUNDS.
Refunds, upon authorization by Eclicks, Inc., will be issued within
30 days of authorization to the Client’s credit card account,
or by check, depending on the method of payment that was used.
MODIFICATIONS TO DOMAIN NAME INFORMATION.
Eclicks, Inc. will assist Client in modification of domain contact
information to Eclicks, Inc., but not away from Eclicks, Inc. to
a competitor. Service to assist with domain name modifications
other than Technical Contact will be charged a fee of $50 per hour with a
minimum $25.00 assistance fee.
TERMINATION OF SERVICE.
Under our Terms of Service, we provide you with website hosting/streaming and
development, except under the following circumstances:
- Use of webhosting for an illegal activity. Using the Services to
transmit any material that, intentionally or unintentionally, violates
any applicable local, state, national or international law.
- Use of webhosting to transmit any material that threatens or encourages bodily harm,
destruction of property, harassement/stalking, and any other activities
that are negative in nature to persons, organizations or businesses.
- Use of webhosting to make fraudulent offers to buy/sell products,
and/or services.
STREAMING MEDIA DELIVERY.
Eclicks, Inc. will make best efforts to
in the transmission of your programs, both live and "on-demand." However,
our equipment and personnell are only one part of the infrastructure necessary
for such transmission. We will not be held responsible for the failure of other
parts of the Internet / phone / media lines that are not under our direct
control, nor for Acts of God, natural disasters, acts of terrorism, or any other
acts or occurrences beyond our control that interfere with transmission
of your data.
CLIENT DATA.
Eclicks, Inc. provides no warranties, express or implied, for any of its
products or services. Eclicks, Inc. further agrees to make a good faith
effort to restrict unauthorized access to the client's data. However, due to
the insecure nature of the World Wide Web and the Internet, the client assumes
full responsibility for providing appropriate security within the client's
own directories. Eclicks, Inc. is not responsible for loss of data. Even though
Eclicks, Inc. conducts back-ups, due to the insecure nature of
the Internet, we cannot guarantee the security of the client's data.
Client should therefore back-up their own data.
MODIFICATIONS OF TERMS OF SERVICE.
Eclicks, Inc. reserves the right to alter these terms of service at any
time. These terms of service were last modified on March 15, 2002.
NOTICE. As Of September 15, 2002, SConline.info, LLC and all of its agreements,
assets, clients, warrantees, etc. have been transferred to Eclicks, Inc.
